Abstract:
Effective implementation of cultural heritage legal frameworks is decisive on managing cultural
heritages.This study basically attempted to examine legal frameworks and their implementation
on managing cultural heritages in Awi Zone as its grand objective. Besides, it assessed how
cultural heritage legal frameworks have been implemented and also discussed on how Awi Zone
Culture and Tourism Desk is integrated among stakeholders on implementing cultural heritage
legal frameworks. Additionally, challenges and gaps of implementing cultural heritage legal
frameworks are described. To achieve the objectives; descriptive research design of qualitative
research approach was employed. Purposive sampling technique was utilized to identify
knowledgeable informants on the issue understudy. Hence, culture and tourism sector officers
and heads, police officers, judges, religious men, zone and woreda administrators were target
population. Semi-structured interview, observation and document review were used as the main
data collection methods. Finally, the data was interpreted and analyzed by using thematic data
analysis. As the findings of the study revealed the implementation of legal frameworks on
managing cultural heritages in Awi has several problems; hereupon legal frameworks on
managing cultural heritages in Awi zone are not appropriately implemented. This is due to the
obstructions such as; inadequacy of legislations, poor operational capacity of the law, absence
of enforcing legal frameworks for the decree legislations, lack of awareness on heritage owners
and stakeholders, inaccessibility of infrastructures, budgetary constraints, displacement of
professionals, ownership related gaps of the law, the change of heritage registration formats,
absence of HIA works, weak institutional integrations, low attentions for the law
implementation modes, lack of trained man power, absence of museums and property houses,
problem of appointing the right man at the right place, poor consideration for customary laws
and indigenous knowledge, theft and poverty. Finally, the study conveys the urgent need on
conducting further comprehensive and more detail study on such issues to safeguard cultural
heritages using the appropriate legal and operational frameworks of managing the
irreplaceable heritages of the study area and the country at large.
